Plaintiff claimed excessive force, false arrest and malicious prosecution following a narcotics officer’s use of force when startled by the plaintiff inside a vacant apartment during a narcotics investigation. The plaintiff claimed she was punched in the face, and was subsequently arrested and charged with battery. The jury deliberated in just over an hour, and found the officer not liable on all three claims. Of note, Judge Marovich, the trial judge, announced after the verdict that this case was the last jury trial he would preside over prior to retirement. (Tried September of 2014).
