Roger Littman and Omar Fayez obtained a not guilty verdict on behalf of a neurologist in a case involving treatment of a ruptured cervical disc which had compromised spinal cord function.
The plaintiff patient appeared at the emergency room with complaints of pain and difficulty walking. The ER doctor admitted the plaintiff to the hospital and then contacted our client to request that he examine the plaintiff. The next day, our client saw the patient, whose condition was significantly worse. It took several hours to obtain an MRI. After the scan, the patient could no longer move his legs. Surgery was successful in decompressing a ruptured cervical disc that had compromised spinal cord function. After lengthy rehabilitation, the plaintiff recovered most function.
The plaintiff asked the jury to award $1.6 million. We made no offer to settle the case. The jury awarded a Not Guilty verdict to all defendants.
