Q&H Wins Summary Judgment In Federal Trucking Fraud Case

Congratulations to Querrey & Harrow shareholders Terrence Guolee and Larry Kowalczyk on their April 19, 2018 receipt of an order granting summary judgment on liability from the Federal District Court for the Northern District of Illinois, Eastern Division. 

In the case, Q&H alleged on behalf of its client, a nationwide insurer of interstate trucking carriers, that the defendant insurance broker forged monthly mileage reports reflecting lower mileage totals than reported by the insured trucking carriers in order to report lower insurance premiums.

After several years of litigation, depositions and forensic review and analysis of hundreds of thousands of pages of material, Q&H moved for summary judgment on behalf of its client, the plaintiff in the case. While awards of summary judgment to plaintiffs are rare, the court granted summary judgment on counts alleging breach of fiduciary duty, unjust enrichment, negligent supervision, accounting and fraud.

The matter now moves to the damages phase of the case where Querrey & Harrow's client will be seeking several million dollars in compensatory and punitive damages and reimbursement of attorney fees and costs against the offending broker.
